Do the police have to read my rights?

Usually the answer is no, say for example, the police are questioning you about some crime but you haven't yet been charged. In the event you haven't been charged, anything you say can be used against you and you actually don't have "the right to remain silent". Oftentimes clients come into my office and asked me if their case can be thrown out if the police didn't read them their rights. The Miranda rights only apply event that you have been arrested and detained, they do not apply if you are simply being questioned by some detectives.
